Merchant Terms
Effective 16 October 2026
These terms are an agreement between your business (“you”) and PerkHour about posting perks on PerkHour. By creating a merchant account, posting a perk or closing a ticket at your register, you agree to them on behalf of your business. If you don’t agree, please don’t use PerkHour.
What PerkHour does
PerkHour shows time-limited perks from local shops to people nearby. A customer claims your perk with their phone number and shows a ticket code at your counter. You check the code in the PerkHour register and close the ticket. PerkHour does not sell your goods and does not take payment from your customers.
Your account and verification
- You must be at least 18 and allowed to act for the business.
- The details you give us about your business must be true and kept up to date.
- We verify each shop before its perks go live, by matching your Google Business Profile or by a check from our team. We may ask for more information, and we may decline a shop we can’t verify.
- You are responsible for everyone you give access to, including staff using the register, and for keeping sign-in details and paired devices secure.
Pricing
Free to start. Your first 30 days or first 50 redemptions are free, whichever comes first. The free period starts at your first redemption.
After that, $1 for each redemption, never more than $99 a month. You pay only for tickets closed at your register. Expired, cancelled and voided tickets are never billed.
- No signup fee and no card at signup. We ask for a card or US bank account when your free period ends. Payments are handled by our payments processor.
- Mistakes. You can undo a redemption for 2 minutes after closing it, and void it from your redemption history for 24 hours. Voided redemptions aren’t billed and don’t count toward the 50 free ones.
- Invoices. We bill monthly for the redemptions in that month, up to the cap. Your billing page in the portal shows the count, the amount so far and your invoices.
- Failed payments. If a payment fails, we’ll email and text you. After 7 days, new perks stop going live until it’s fixed. We never cancel a customer’s live ticket because of billing, so please honor those.
- Price changes. We may agree a different price, cap or free period with you in writing. We’ll give you at least 30 days’ notice before changing the standard price for you.
- PerkHour-funded perks. Sometimes PerkHour adds money to a perk (shown as “PerkHour covers $1”). We pay you that amount for each redeemed ticket that carried it, as a credit on your invoice or by bank transfer, usually weekly.
- Prices don’t include taxes. You pay any taxes on what you sell.
Your perks
- Honor the perk as posted. If a customer shows a live ticket for your perk at your shop before it ends, give them the perk as it was shown. If an item has sold out, offer something fair or explain, and tell us if it keeps happening.
- Be clear and truthful. Say exactly what the perk is and any condition that matters. No bait pricing, hidden conditions or misleading claims.
- Stay within the limits. A discount between 10% and 50%, or a fixed price; between 30 minutes and 4 hours long; and at most 3 perks running at the same time at each shop.
- Follow the law. Your perks, goods and services must follow the laws that apply to your business, including pricing, food safety and consumer protection rules.
- Recurring perks. A weekly perk you set up keeps going live on its schedule until you pause or end it. You can skip one occurrence at any time.
No alcohol perks
While our alcohol block is on, you may not post perks on alcoholic drinks, including free or discounted drinks and drink bundles. We check for this when you post, and we remove any that get through. We’ll tell you if this changes.
Posting by text
- Your numbers. You can verify up to 3 mobile numbers for each shop. Only a verified number can post perks by text, and only for its own shop. When you verify a number, you agree to this: “Text me about my perks and let me post perks by text. Message and data rates may apply. Reply HELP for help, STOP to cancel.”
- The merchant number. You text perks to the PerkHour merchant number shown in your portal. It is for shops only. Don’t share it with customers.
- Nothing goes live without YES. We reply with a preview of the perk. Reply YES to publish it, EDIT to change it or NO to cancel. You can also text PAUSE, RESUME, CLOSE, STATUS and SKIP.
- Check the preview. You are responsible for a perk you confirm with YES, as if you had posted it in the portal.
- Reply HELP for help. Reply STOP to cancel. After STOP, that number gets no more texts from us and can’t post by text until you reply START.
- Message and data rates may apply. How often we text depends on how you use PerkHour; we reply to each text you send. Our SMS Terms cover the rest.
Removing perks and suspending accounts
- We may remove or pause a perk, or hold it for review, if it breaks these terms, if customers report a problem with it, or if we think it could harm customers or PerkHour.
- We may suspend or close your account for serious or repeated breaches, such as not honoring perks, misleading perks, claiming your own perks, or abusing customers or our team. Where we can, we’ll tell you why and give you a chance to fix it first.
- You can pause your perks or close your account at any time. You still pay for redemptions closed before then.
- Listed specials. Before a shop joins, we may list a special it has already published, such as a happy hour on its own website, marked as a listing. A shop that doesn’t want to be listed can ask us to remove it on our takedown page.
Data
- Customer data. You never see a customer’s phone number. When a ticket is shown, you see the ticket code, the perk and when it was claimed. You agree not to try to identify customers from PerkHour data, or to contact them about PerkHour perks outside PerkHour.
- Your numbers. Your portal shows your perks, claims, redemptions and an estimate of new customers. You can use them for your own business.
- Your content. You keep ownership of your shop’s name, photos and perk text. You give us permission to show them on PerkHour, in our texts and printed cards, and to promote PerkHour in your area. You confirm you have the right to give that permission.
- How we use your data. We use your business and account details to run PerkHour, bill you and improve the service, including the texts you send to post perks. Our Privacy Policy explains more.
Fair use
You agree not to:
- claim your own perks, or ask staff, friends or family to claim them to boost your numbers;
- close tickets that weren’t really shown at your counter;
- interfere with PerkHour, get around its limits, or access data that isn’t yours; or
- use PerkHour for anything illegal.
Disclaimers and liability
We work hard to keep PerkHour running, but we provide it “as is”. We don’t promise a number of customers, claims or redemptions. To the extent the law allows, we are not responsible for indirect losses such as lost profits, and if we are responsible for a loss, the most we will pay is what you paid us in the 12 months before the claim. You are responsible for your perks, goods and services, and for claims that arise from them.
Changes
We may update these terms. We’ll post the new version on this page, change the effective date and email you about any important change at least 30 days before it applies to you. If you keep using PerkHour after that, the new terms apply.
Governing law
