Terms of Use
Effective 16 October 2026
These terms are an agreement between you and PerkHour about using PerkHour on perkhour.com and by text message. By claiming a perk or otherwise using PerkHour, you agree to these terms. If you don’t agree, please don’t use PerkHour.
What PerkHour is
PerkHour shows time-limited perks from local shops near you, such as a discount or a free extra for a short time. You claim a perk with your phone number and show a code at the counter. PerkHour is free for customers.
Who can use PerkHour
- You must be 18 or older.
- You must be in the United States and use a US mobile number that is yours, or that you have the account holder’s permission to use.
- You confirm both each time you claim.
How claims work
- Verify your number. We text you a one-time code. On the same browser, we may remember your device for 30 days so you don’t need a new code each time.
- Be nearby. Perks are for people close to the shop. When you claim, we check your distance from the shop using your browser’s location.
- One live ticket per shop. You can hold one live ticket at each shop at a time. We may also limit how many perks you can claim in a day.
- Tickets last 30 minutes. Your ticket shows a code and the time it ends. Show it at the counter before then. After that it can’t be used. You can cancel a ticket you no longer need.
- The shop decides at the counter. Perks are offered by shops, not by PerkHour. Each shop sets its perk and its conditions and is responsible for honoring it. Staff check your ticket at the counter and decide whether the perk applies, for example if an item has sold out.
- Perks can end early. Perks have a limited number of claims and can end or sell out at any time.
- You pay the shop. Any purchase is between you and the shop. PerkHour does not sell the goods or services and does not take payment from you.
Fair use
You agree not to:
- use a fake, temporary or someone else’s phone number;
- claim perks with bots, scripts or any other automated means;
- sell, trade or transfer tickets;
- fake your location;
- claim perks at a shop you work for;
- interfere with PerkHour, get around its limits, or access data that isn’t yours; or
- abuse or harass shop staff.
If you break these rules, we may cancel your tickets and block your number.
No alcohol perks
PerkHour does not list perks on alcohol. Shops may not use PerkHour to offer free or discounted alcoholic drinks.
Text messages
Our SMS Terms explain the texts we send and how to stop them.
Your privacy
Our Privacy Policy explains what we collect and how we use it.
Disclaimers
We work hard to keep PerkHour running and accurate, but we provide it “as is”. We don’t promise that PerkHour will always be available, that a perk will still be available when you arrive, or that a shop will honor a perk. Shops are responsible for their perks, goods and services. Location readings can be inaccurate, so a claim may sometimes be refused even when you are close.
Limits on our liability
To the extent the law allows:
- we are not responsible for indirect losses, such as lost time, lost savings or lost profits;
- we are not responsible for what shops do or fail to do, or for their goods and services; and
- if we are responsible for a loss, the most we will pay is $100.
Some states don’t allow some of these limits, so they may not all apply to you. Nothing in these terms limits rights you have by law that can’t be waived.
Ending use
You can stop using PerkHour at any time and ask us to delete your data (see our Privacy Policy). We may suspend or end PerkHour, or your access to it, at any time.
Shops
These terms are for customers. Shops that post perks also agree to our Merchant Terms.
Changes
We may update these terms. We will post the new version on this page and change the effective date. If you keep using PerkHour after that, the new terms apply.
